Bondly - Terms of Use

1. Welcome to Bondly!
These Terms of Use ("Terms") govern your access to and use of the Bondly mobile application (the "App"), provided by THE DOT IT, located at str. Gherman Pintea 102 ("Bondly," "we," "us," or "our"). By downloading, installing, accessing, or using the App, you ("you" or "User") agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.
In short: By using Bondly, you're agreeing to these rules. Please read them carefully.

2. Who Can Use Bondly?
Bondly is designed to support connection and growth between romantic partners. By using the App, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. The App is not intended for use by individuals under the age of 18.
In short: You need to be an adult to use Bondly.

3. Account Pairing

3.1 Pairing Process:
Bondly allows two individuals in a romantic relationship to pair their accounts, enabling them to share a single subscription and access shared features. One user will initiate the pairing process, and the other user must accept the invitation within the App.

3.2 Shared Data:
By pairing accounts, you understand and agree that certain information and content within the App will be visible and shared between you and your partner. This may include, but is not limited to:
  • Responses to daily prompts (questions, quizzes, homework).
  • Relationship check-in data and visual graphs.
  • Usage patterns within shared features.

3.3 Limitations and Unpairing:
While paired, each user maintains their individual account credentials. The user who initiated the subscription will be responsible for payment. Either user can unpair their accounts at any time. Unpairing may result in loss of access to shared relationship history and partner-linked features for the non-subscriber.
In short: When you pair with your partner, some of your activity and responses will be visible to them. Unpairing can limit access to shared information, especially for the person who didn't subscribe.

4. Subscription Terms and Payments

4.1 Shared Subscription:
Bondly offers a shared subscription model for paired users. By subscribing, you gain access to premium features and content as described within the App.

4.2 Billing and Auto-Renewal:
Subscription fees will be billed to the payment method you provide at the time of purchase. Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew for the same duration, and your payment method will be charged the then-current subscription fee.

4.3 Cancellation:
You can manage and cancel your subscription through your account settings in the Apple App Store or Google Play Store, depending on where you initially purchased the subscription. Cancellation will be effective at the end of the current billing period.

4.4 Refunds:
Payments are non-refundable, and we do not provide refunds or credits for any partial subscription periods, except as required by applicable law or our specific refund policy communicated to you. If you cancel your subscription, you will not receive a refund for the period remaining until the end of the subscription period in which you cancelled, unless otherwise required by applicable law.

4.5 Free Trials:
We may offer free trial periods, typically lasting for one month. If you sign up for a free trial, you will be automatically charged the applicable subscription fee after the trial period ends, unless you cancel before the end of the trial. Trial eligibility may be limited.

4.6 In-App Purchases:
The App may offer other digital products for purchase. The terms and conditions of the respective app store will apply to these purchases.
In short: Bondly is a subscription service that renews automatically. You can cancel anytime through your app store settings, but refunds are generally not provided for the remaining subscription period unless legally required. Free trials usually last one month.

5. Your Responsibilities
By using Bondly, you agree to the following:
  • Use the App Lawfully: You will use the App in compliance with all applicable laws, rules, and regulations.
  • Respect Others: You will not use the App to engage in any form of harassment, bullying, discrimination, hate speech, or any other offensive or harmful conduct towards other users or any third party.
  • No Impersonation: You will not impersonate any other person or entity.
  • No Illegal Activities: You will not use the App for any illegal or unauthorized purposes.
  • Protect Your Account: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or use of your account.
  • No Interference: You will not interfere with or disrupt the operation of the App or the servers and networks connected to the App, including by transmitting any viruses, worms, or other malicious code.
  • No Reverse Engineering: You will not attempt to reverse engineer, decompile, or disassemble any part of the App.
  • No Unauthorized Data Collection: You will not collect or solicit personal information from other users without their explicit consent.
  • No Spam or Unsolicited Communications: You will not use the App to transmit chain letters, junk email, spam, or any other form of unsolicited communications.
  • Provide Accurate Information: You will provide accurate and up-to-date information when creating your account and using the App.
In short: Be respectful, use Bondly legally, keep your account safe, and don't try to mess with how the App works or collect other people's data without permission.

6. Health and Relationship Disclaimer
BONDLY IS NOT A MEDICAL APP AND DOES NOT PROVIDE MEDICAL, THERAPEUTIC, OR CLINICAL ADVICE.
The content and features of the App are intended for self-reflection, education, and interpersonal connection in romantic relationships. They are not a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of a qualified healthcare professional for any questions you may have regarding your physical or mental health. If you are experiencing a mental health crisis or need professional help, please contact a crisis hotline or mental health professional in your area.
In short: Bondly is for connection and learning, not for medical or therapy advice. If you need professional help, please seek it.

7. Data and Privacy
We collect and process your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. You can access our full Privacy Policy at bondly.app/privacy-policy. Please review our Privacy Policy to understand how we collect, use, and protect your information, including the types of personal data we collect, the purposes of processing, the legal bases for processing (where applicable), our data retention practices, and your rights regarding your data under GDPR, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), the Virginia Consumer Data Protection Act (VCDPA), the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Utah Consumer Privacy Act (UCPA), the Washington My Health My Data Act (MHMDA), and other applicable data protection laws.
We use third-party services such as RevenueCat (for managing billing and subscriptions) and PostHog (for app analytics). These providers may process limited user data to help us operate the App effectively. Our Privacy Policy provides more details about these and any other third-party service providers we use.
If you reside in the European Union, your data may be transferred to and processed in countries outside the EU, including the United States. We rely on appropriate safeguards such as Standard Contractual Clauses approved by the European Commission to ensure an adequate level of data protection for such transfers.

Upon account termination, we may retain certain information for legal, administrative, or security purposes, as outlined in our Privacy Policy.
By using the App, you consent to the collection, processing, and transfer of your data as described in our Privacy Policy. We implement reasonable security measures to protect your data, but no system can guarantee absolute security.
In short: Your privacy is important. Our Privacy Policy at bondly.app/privacy-policy explains in detail how we handle your data, your rights, and the third-party services we use. If you're in the EU, your data might be transferred with specific safeguards. We may keep some data even after you close your account, as explained in our Privacy Policy. Please read it carefully.

8. Content Ownership and Intellectual Property
The App and its original content, features, and functionality (including but not limited to text, graphics, logos, user interface, visual design, and software) are and will remain the exclusive property of THE DOT IT and its licensors. They are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the content on our App, except as expressly permitted by these Terms.
In short: Bondly owns the App and its content. You can use it for personal use, but you can't copy or distribute it without our permission.

9. Termination of Use

9.1 By You:
You may terminate your account at any time by following the instructions within the App or through the respective app store.

9.2 By Bondly:
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and without notice or liability to you. Reasons for termination may include, but are not limited to, your breach of these Terms, violation of applicable laws, conduct that we deem harmful to the App or other users, or if we believe, in our sole discretion, that your behavior poses a risk to the safety or well-being of others.

9.3 Effect of Termination:
Upon termination, your right to access and use the App will immediately cease. Your subscription will be handled according to the cancellation terms outlined in Section 4.
In short: You can stop using Bondly whenever you want. We can also stop your access if you break the rules or if we believe your behavior is harmful.

10. Disclaimer of Warranties and Limitation of Liability

10.1 Disclaimer of Warranties:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BONDLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. BONDLY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE THE APP AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING UPTIME, DATA ACCURACY, OR SUITABILITY FOR ANY PARTICULAR PURPOSE.

10.2 Limitation of Liability:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BONDLY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF BONDLY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BONDLY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP EXCEED THE AMOUNT YOU PAID TO BONDLY, IF ANY, IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE THE CLAIM AROSE.
In short: We provide Bondly as it is, without guarantees about uptime or accuracy. Our liability for any issues is limited by law.

11. Dispute Resolution and Governing Law
11.1 Governing Law:
These Terms and your use of the App will be governed by and construed in accordance with the laws of the State of Delaware, U.S.A., without regard to its conflict of law principles. You agree that the App is deemed a passive application that does not give rise to personal jurisdiction over Bondly in jurisdictions other than Delaware. To the extent the laws of your jurisdiction provide mandatory consumer protection regulations that cannot be waived, those regulations shall apply in addition to these Terms.

11.2 Informal Dispute Resolution:
We encourage you to contact us directly if you have any concerns or disputes. We will try to resolve disputes informally by contacting you via email.

11.3 Mandatory Binding Arbitration and Class Action Waiver:
You agree that any and all disputes, claims, or controversies arising out of or relating to these Terms or the App (including, without limitation, disputes regarding the interpretation, breach, termination, validity, non-performance, or application of these Terms) shall be exclusively resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules (the “AAA Rules”). The arbitration shall take place in Delaware, unless otherwise agreed upon in writing by both parties. The language of the arbitration shall be English. The arbitrator shall have the authority to grant any relief that would be available in court. You and Bondly agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and Bondly otherwise agree in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. The decision of the arbitrator shall be final and binding on the parties. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

11.4 Exception to Arbitration:
Notwithstanding the foregoing arbitration provision, both you and Bondly retain the right to pursue in small claims court any claim that is within that court’s jurisdiction and proceeds on an individual (non-class) basis.

11.5 Jurisdiction:
To the extent that any legal suit, action, or proceeding is permitted under these Terms (including for enforcement of an arbitration award), you and Bondly irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Delaware.
  • For EU Users: If you are a consumer residing in the European Union, you may have the right to bring a claim in your local jurisdiction and may also have access to online dispute resolution platforms provided by the European Commission. Nothing in this Section 11 shall be construed to deprive you of any mandatory consumer protection rights under the laws of your country of residence.
In short: The laws of Delaware govern these terms, but your local consumer rights still apply. We prefer to solve issues amicably, but we will use mandatory individual arbitration in Delaware, and you waive the right to participate in class actions. There's a small claims court exception. EU users have additional rights under their local laws.

13. Third-Party Services
The App may contain links to third-party websites or services that are not owned or controlled by Bondly. Bondly has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Bondly shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
In short: We are not responsible for other websites or services you might access through Bondly.

14. Platform-Specific Terms
14.1 Apple App Store:
By downloading the App from the Apple App Store, you acknowledge and agree to Apple's standard End User License Agreement (EULA) as incorporated herein by reference. You also acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. You also acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

14.2 Google Play Store:
By downloading the App from the Google Play Store, you acknowledge and agree to the Android Market Terms of Service as incorporated herein by reference. You understand that Google is not responsible for providing support services for the App.
In short: If you downloaded Bondly from the Apple App Store or Google Play Store, you also agree to their rules.
